By downloading, installing, or using the CashClaim mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

3. User Responsibilities

You are responsible for:

• Verifying your eligibility for settlements independently
• Submitting claims directly through official settlement websites
• Maintaining the confidentiality of your account credentials

4. Subscription and Fees

CashClaim offers subscription plans for unlimited access to settlement information:

• Weekly subscription: $5.99 per week
• Annual subscription: $59.99 per year

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.

5. Disclaimers

CashClaim is an information service only. We are not a law firm and do not provide legal advice. Settlement information is gathered from public sources and may not be complete or current. Always verify information with official settlement administrators.

6. Limitation of Liability

CashClaim shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the App, including but not limited to missed claim deadlines or rejected claims.

7. Privacy

Your use of the App is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices regarding the collection and use of your information.

8. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the App constitutes acceptance of the modified Terms.

11. Class Action Settlement Information

CashClaim aggregates publicly available information about class action settlements. We do not:

• Represent you in any legal proceedings
• File claims on your behalf
• Guarantee the accuracy or completeness of settlement information
• Guarantee that you will receive any payment from settlements
• Provide legal representation or advice regarding your eligibility

You are solely responsible for determining your eligibility, submitting claims correctly, and meeting all deadlines. We strongly recommend consulting with a qualified attorney if you have questions about your legal rights.

12. Indemnification

You agree to indemnify, defend, and hold harmless CashClaim, its officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from:

• Your violation of these Terms
• Your use of the App
• Any claim submissions you make
• Your violation of any rights of another party
• Your violation of any applicable laws

13. Arbitration Agreement

PLEASE READ CAREFULLY: By using CashClaim, you agree that any dispute or claim relating to these Terms or your use of the App will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if eligible.

Class Action Waiver: You agree that any arbitration will be conducted on an individual basis and not as a class action or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Intellectual Property

All content, features, and functionality of the CashClaim App, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are the exclusive property of CashClaim or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

15. User Content and Conduct

You agree not to use the App to:

• Submit false or misleading information
• Impersonate any person or entity
• Violate any applicable laws or regulations
• Interfere with or disrupt the App or servers
• Attempt to gain unauthorized access to any portion of the App
• Use any automated system to access the App
• Harvest or collect information about other users

16. Warranty Disclaimer

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. CASHCLAIM DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

17. Geographic Restrictions

CashClaim is based in the United States and is intended for use by U.S. residents only. We make no claims that the App or any of its content is accessible or appropriate outside of the United States. Access to the App may not be legal by certain persons or in certain countries.

18. Force Majeure

CashClaim shall not be liable for any failure or delay in performance under these Terms which is due to acts of God, natural disasters, pandemic, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in Delaware.

20. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

21. DMCA Policy

CashClaim respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe your copyrighted work has been infringed, please notify our DMCA Agent:

We will terminate repeat infringers in appropriate circumstances. False claims may subject you to liability under Section 512(f) of the DMCA.

22. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the App, constitute the entire agreement between you and CashClaim concerning your use of the App.
