1. Agreement to Terms

This End User License Agreement ("EULA") is a legal agreement between you and CashClaim, Inc. ("CashClaim," "we," "us," or "our") for the CashClaim mobile application, including all related documentation, updates, and services (collectively, the "App").

By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by this EULA. If you do not agree, do not use the App.

2. License Grant

Subject to your compliance with this EULA, CashClaim grants you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on mobile devices owned or controlled by you
• Access and use the App on such devices strictly for personal, non-commercial purposes
• Access content and information made available through the App

3. License Restrictions

You SHALL NOT:

• Copy, modify, or create derivative works based on the App
• Distribute, transfer, sublicense, lease, lend, or rent the App to any third party
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
• Remove, alter, or obscure any proprietary notices on the App
• Use the App for any illegal, unauthorized, or commercial purposes
• Access the App through automated means (bots, scrapers, etc.)
• Interfere with or disrupt the App's functionality
• Attempt to gain unauthorized access to our systems or networks
• Use the App to harvest or collect data about other users
• Share your account credentials with others

4. Intellectual Property Rights

The App and all rights, title, and interest in and to the App (including all intellectual property rights) are and will remain the exclusive property of CashClaim and its licensors. This EULA does not grant you any rights to trademarks, service marks, or logos used in the App.

You acknowledge that the App contains proprietary and confidential information protected by applicable intellectual property and other laws.

5. User Accounts

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring that all information you provide is accurate and current

6. Subscription Terms

Access to certain features requires a paid subscription:

• Subscriptions are billed in advance on a recurring basis
• You authorize us to charge your payment method for renewal
• Subscriptions automatically renew unless canceled
• You must cancel at least 24 hours before renewal to avoid charges
• No refunds for partial subscription periods

7. Updates and Modifications

CashClaim may, in its sole discretion:

• Update, modify, or discontinue the App at any time
• Add or remove features or functionality
• Impose limits on certain features or restrict access to the App
• Require you to accept updates to continue using the App

8. Privacy and Data Collection

Your use of the App is subject to our Privacy Policy, which is incorporated by reference into this EULA. By using the App, you consent to our collection and use of your information as described in the Privacy Policy.

9. NO WARRANTIES

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. CASHCLAIM EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• TITLE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY OF INFORMATION
• UNINTERRUPTED OR ERROR-FREE OPERATION

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CASHCLAIM BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, DATA, USE, OR GOODWILL
• SERVICE INTERRUPTION OR LOSS OF BUSINESS
• DAMAGES EXCEEDING $100 USD

THESE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF CASHCLAIM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Indemnification

You agree to defend, indemnify, and hold harmless CashClaim and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorneys' fees) arising from:

• Your use of and access to the App
• Your violation of this EULA
• Your violation of any third-party right
• Any claim that your use caused damage to a third party

12. Export Compliance

You may not use or export the App except as authorized by United States law and the laws of the jurisdiction in which the App was obtained. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country.

13. Termination

This EULA is effective until terminated. Your rights under this EULA will terminate immediately and automatically without notice if you fail to comply with any term. Upon termination:

• All rights granted to you will cease
• You must stop using the App
• You must delete all copies of the App from your devices

14. Severability and Waiver

If any provision of this EULA is held invalid or unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision will not be considered a waiver of such right or provision.

15. Entire Agreement

This EULA, together with our Terms of Service and Privacy Policy, constitutes the entire agreement between you and CashClaim regarding the App and supersedes all prior agreements and understandings.
